Welcome to Leftie Studio (“Leftie Studio”, “we”, “us”, “our”). We operate this website and store, along with all related information, content, features, tools, products and services (the “Services”), to offer you a curated shopping experience. Leftie Studio is powered by Shopify, which enables us to provide the Services.

These Terms of Service (“Terms”) together with any policies referenced here (including our Privacy Policy and Returns & Refunds Policy) describe your rights and responsibilities when using the Services.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Access and Account

  • By using the Services, you confirm you are 18 years or older (age of majority in the UK) and, where relevant, you consent to any minor dependants using the Services on devices you own or manage.
  • You may be asked to provide information such as your name, email, billing, payment and shipping details. You warrant that all information supplied is accurate, current and complete, and that you have the right to provide it.
  • You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account.

2. Our Products

  • We make every effort to present our products accurately. Colours and appearance may vary due to device settings and display differences.
  • We do not warrant that products will meet your individual expectations.
  • Product descriptions, prices and availability may change at any time without notice. We may discontinue products or limit quantities to any person, region or jurisdiction at our discretion.

3. Orders

  • When you place an order, you make an offer to purchase. We may accept or decline your order at our discretion. Your order is accepted when we send a confirmation and have processed your payment.
  • Please check orders carefully before submitting; we may be unable to accommodate cancellation requests after acceptance. If we decline, change or cancel an order, we will attempt to notify you using the contact details provided at checkout.
  • Your purchases are subject to our Returns & Refunds Policy.
  • You warrant that purchases are for personal or household use and not for commercial resale or export.

4. Prices and Billing

  • Prices, discounts and promotions may change without notice. The price charged is the price shown at checkout when you place the order and confirmed by email. Unless expressly stated, prices exclude shipping, handling, customs or import charges and taxes due on import.
  • Promotions may be governed by separate terms. If there is a conflict, the promotion terms apply.
  • You agree to provide current, complete and accurate purchase and account information and to promptly update details (email, payment card, expiry dates) so we can complete transactions and contact you as needed.
  • You represent and warrant that: (i) payment details are true, correct and complete; (ii) you are authorised to use the selected payment method; (iii) charges will be honoured by your provider; and (iv) you will pay all charges at posted prices, including shipping and applicable taxes/duties.

5. Shipping and Delivery

  • Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control.
  • Title and risk pass to you when we hand items to the carrier. For international orders, you are responsible for any import duties and taxes levied by your destination country.

6. Intellectual Property

  • The Services and all content (including text, images, graphics, designs, video, audio, logos, product names and arrangements) are owned by Leftie Studio or our licensors and are protected by intellectual property laws.
  • You may use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works of, publicly display, perform, republish, download, store or transmit any materials without prior written consent, except as permitted by law.
  • Leftie Studio names, logos, product names and slogans are our trademarks or those of our affiliates/licensors. You must not use them without prior written consent. Shopify names and logos are trademarks of Shopify. Other names/logos are the property of their respective owners.

7. Optional Tools

  • We may provide access to tools or features from third parties, which we do not monitor or control.
  • Such tools are provided “as is” and “as available” without warranties or endorsement. Your use is at your own discretion and risk and may be subject to the third party’s terms.

8. Third-Party Links

  • The Services may link to third-party websites or content. We are not responsible for examining or evaluating third-party materials and disclaim liability for your use of them.
  • Review third-party terms and policies carefully. Complaints or queries about third-party products or services should be directed to the relevant third party.

9. Relationship with Shopify

Leftie Studio is powered by Shopify, which enables us to provide the Services. However, any sales and purchases you make in our store are between you and Leftie Studio. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Leftie Studio, including any injury, damage, or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Leftie Studio.

10. Privacy

  • Personal information collected through the Services is handled in line with our Privacy Policy LINKLINKLINK and UK data protection law (UK GDPR and the Data Protection Act 2018).
  • Because our store is hosted by Shopify, Shopify collects and processes certain personal information to operate and improve the Services. Information you submit may be transmitted to Shopify and relevant service providers, which may be located outside the UK. See our Privacy Policy and Shopify’s Privacy Policy for details.

11. Feedback (Reviews, Ideas, Suggestions)

  • If you submit reviews, ideas, suggestions or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback for any purpose, including commercial purposes.
  • You warrant you own or control the rights in the Feedback; you have disclosed any incentives; and your Feedback complies with these Terms and the law. We may (but are not obliged to) monitor, edit or remove Feedback we deem unlawful, offensive, misleading, infringing or otherwise objectionable.

12. Errors, Inaccuracies and Omissions

From time to time, the Services may contain typographical errors or inaccuracies (e.g., product descriptions, pricing, promotions, shipping charges, transit times, availability). We reserve the right to correct errors and update or cancel orders where information is inaccurate, including after you have submitted an order.

13. Prohibited Uses

You may use the Services only for lawful purposes. You must not, directly or indirectly:

  • violate any applicable laws or regulations;
  • infringe intellectual property or privacy rights;
  • harass, abuse, defame or harm others;
  • transmit false or misleading information;
  • upload malicious code or attempt to disrupt the Services;
  • collect or track others’ personal information without lawful basis;
  • spam, phish, crawl or scrape;
  • bypass or interfere with security features; or
  • engage in conduct that restricts or inhibits anyone’s use of the Services or exposes us, Shopify, or users to liability.

We may suspend or terminate access if we believe you have breached these Terms.

14. Termination

We may terminate or suspend the Services (or any part) at any time, in our discretion, without notice. You remain liable for all amounts due up to the date of termination.
Sections intended to survive (including Intellectual Property, Feedback, Disclaimer, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law) will continue to apply.

15. Disclaimer of Warranties

  • Information on the Services is provided for general information only. We do not warrant its accuracy, completeness or usefulness and your reliance is at your own risk.
  • Except as expressly stated by Leftie Studio or required by law, the Services and all products are provided “as is” and “as available”, without any express or implied warranties, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, durability, title and non-infringement.
  • Some rights cannot be excluded under UK law. Nothing in these Terms affects your statutory rights, including your rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013.

16. Limitation of Liability

  • To the fullest extent permitted by law, Leftie Studio, our officers, employees, agents, contractors, service providers and licensors will not be liable for any indirect, incidental, special, consequential or punitive losses (including loss of profits, revenue, data, goodwill or replacement costs) arising out of or related to your use of the Services or any products.
  • Our total aggregate liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.
  • Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. Your statutory rights are not affected.

17. Indemnification

You agree to indemnify and hold harmless Leftie Studio (and our affiliates, officers, employees, agents, contractors, licensors and service providers), as well as Shopify and its affiliates, from losses, damages, liabilities, claims and reasonable legal fees arising from: (1) your breach of these Terms; (2) your violation of law or third-party rights; or (3) your use of the Services. We will notify you of any claim and may control its defence at your expense; we will not settle any claim imposing non-monetary obligations on you without your reasonable consent.

18. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent possible, and the remainder will remain in full force.

19. Waiver; Entire Agreement

A failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with policies referenced or posted on the site (including our Privacy Policy and Returns & Refunds Policy), constitute the entire agreement between you and us regarding the Services and supersede prior agreements or communications.

20. Assignment

You may not assign, transfer or delegate these Terms or your rights or obligations without our prior written consent. We may assign or transfer our rights and obligations without notice.

21. Governing Law

These Terms and any dispute or claim (including non-contractual disputes or claims) are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.

Headings are for convenience only and do not affect interpretation.

You can review the most current version of the Terms at any time on this page. We may update these Terms by posting a revised version and, where required by law, providing notice of material changes. Changes take effect on the date specified in the notice. Your continued use of the Services following changes constitutes acceptance.
